Terms of Service

1. Overview & Agreement

These Terms of Service ("Terms") govern the provision of website design, development, optimization, and ongoing maintenance services by TradiDigital ("we", "us", or "our") to you ("Client", "you"). By ordering a website package, submitting payment, or engaging our services, you agree to be bound by these Terms.

2. Scope of Services & Delivery

TradiDigital designs and develops custom websites specifically for trade and service businesses across Australia and New Zealand.

• Build Timeline: We target delivering your initial complete website build in approximately 7 business days following the receipt of payment and required business details (e.g. logo, service area, contact details).
• Client Co-operation: Timely delivery depends on your prompt provision of necessary content, project photos, and design feedback.
• Revisions: Each package includes the number of revision rounds stated at the time of purchase (Starter: 1 round; Growth: 2 rounds; Premium: 5 rounds). Revisions must be requested within 14 days of receiving your staging preview.

3. Pricing & Payments

All prices are quoted and charged in either Australian Dollars (AUD) or New Zealand Dollars (NZD) as displayed on our Pricing page.

• Fixed Upfront Pricing: Build packages are billed upfront or by agreed milestone before final deployment. Payments may be made via Stripe card checkout or direct bank deposit (ASB Bank).
• No Hidden Surcharges: Published rates are all-inclusive for the stated deliverables. Direct bank deposit carries zero card processing surcharges.
• Care Plan Subscriptions: Ongoing hosting and website maintenance are billed on a recurring monthly or annual basis. You may cancel your Care Plan at any time with 14 days' notice prior to your next renewal date.

4. Intellectual Property & Ownership

We believe in absolute client freedom—no lock-in contracts:

• Client Ownership: Once final payment is completed, you own all rights to the finished website design, text content, and graphics specific to your business.
• Client Materials: You warrant that you own or have permission to use any logos, photos, trademarks, or trade license numbers provided to us for inclusion on your website.
• Portfolio Rights: We reserve the right to display the finished website and screenshots in our portfolio, case studies, and marketing materials unless agreed otherwise in writing.

5. Warranties & Performance

We build our websites adhering to modern W3C standards, mobile-first responsiveness, and Google Core Web Vitals optimization guidelines.

• Search Engine Rankings: While we implement proven on-page SEO best practices, schema markup, and Google Business Profile configurations, we cannot guarantee specific numerical search rankings or Google algorithm positions.
• Third-Party Services: We are not liable for outages, changes in terms, or service disruptions caused by third-party providers including Google, Cloudflare, Stripe, or domain registrars.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law (ACL) and the New Zealand Consumer Guarantees Act (CGA), TradiDigital's total cumulative liability arising out of or in connection with our services shall be strictly limited to the total fees paid by you for the specific project or service under dispute.

7. Termination & Cancellation

Either party may terminate a project if the other party materially breaches these Terms and fails to remedy the breach within 14 days of written notice. In the event of early termination initiated by the Client without cause, completed work up to that date is non-refundable.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand and applicable consumer protection statutes in Australia.
